WA: Signal origins hold key to Sydney hearing findings: curator

PERTH, Feb 2 AAP - Claims the navy covered up the sinking of HMAS Sydney will persist
until authorities deal with the issue of radio signals reported to have come from the
warship, a commission inquiring into the sinking has been told.
Michael McCarthy, curator of the West Australian Maritime Museum and its HMAS Sydney
and HSK Kormoran program since the early 1980s, told the commission in Perth the so-called
"Cooper signals" held the key to its findings.
So called after being heard by RAAF Squadron Leader Eric Cooper at Geraldton on December
4, 1941, it has never been conclusively determined whether the signal "Sydney calling"
referred to Sydney city or HMAS Sydney.
It's always been believed that HMAS Sydney sank on November 19, 1941, following a fierce
battle with the German raider Kormoran off the West Australian coast. All 645 crew perished.
On December 4, Defence's South West Command logged Squadron Leader Cooper as intercepting
signals including the message: "Sydney calling send carrier men on board calling Frazer
D/F Darwin cannot detect you Singapore call Darwin."
The command noted that the message was believed to have come from Sydney city.
Dr McCarthy told Commissioner Terence Cole that the issue was the biggest one confronting
the inquiry.
He said all other public inquiries into the sinking of the Sydney had ignored it.
"This, I think, is the key to the problem we have today," he said.
"(Then director of naval intelligence) Commander RBM Long had an opportunity in 1945,
for reasons he didn't do so.
"There was an opportunity in 1975 when the archives were opened for somebody to be
commissioned to see whether it was all covered up.
"I went to have a look and I could find virtually everything ...
"Why was it then not commissioned when various other folk surfaced in 1991, for example,
as we tried to do. Why was not this brought up at the (1999) federal parliamentary inquiry.
"If we look to negligence on the part of the government, and we're part of the government,
too, we did not attend to this matter when we could have shared it and stopped this thing.
"And if that's where the commission will go and conclude, I think it's wonderful. But
really I would have thought it could have been dealt with before this."
The commission of inquiry has held hearings in Sydney since it began in May last year
and is holding public hearings in Perth until Thursday.
The hearings in Sydney were shown graphic computer reconstructions of the fatal encounter
based on photographs of the wrecks gleaned from the search team that found HMAS Sydney
and HSK Kormoran, and which included Dr McCarthy.
Finding Sydney Foundation director Ted Graham also gave evidence to the inquiry on Monday.

A mesothelioma sufferer, who was exposed to asbestos while visiting a James Hardie
factory nearly 40 years ago has been awarded more than one million dollar compensation
by a jury.
ERIC KING, who is now 62, worked as a machinist and fitter and in 1972 visited a James
Hardie factory in Western Australia, where he conducted maintenance on a machine in the
asbestos sheeting factory.
He visited the Welshpool factory on three occasions for several hours.
Mr KING was not warned about asbestos or given a mask.
A Victorian Supreme Court jury awarded Mr KING today one-point-one-five million dollars
after it found that James Hardie failed to take reasonable care to avoid Mr KING'S exposure
to asbestos and that this caused his mesothelioma.

CANBERRA, Dec 4 AAP - The number of divorces granted in Australia rose for the first
time in almost a decade as some experts suggest the increase could be linked to growing
money worries.
The number of divorces rose to 49,448 in 2009, an increase of five per cent, or 2,239,
on the total in 2008, the latest Australian Bureau of Statistics (ABS) figures reveal.
Once population growth is factored in the rate of marriage breakdown rose from 2.2
divorces per 1000 people to 2.3 per 1000 people in 2009.
It's the first increase in the number and rate of divorces since 2001.
Not-for-profit support group Relationships Australia says the increase could be linked
to the global financial crisis.
"We don't know for sure but we do know whenever we survey people about the factors
that affect their relationship ... the top three are money, work and kids in that order,"
national spokeswoman Anne Hollonds said.
"The last time we did a survey in late 2008, when the GFC was just starting, we found
the number of people that mentioned financial stress as a key factor had more than doubled
in comparison to the previous survey in 2006."
Ms Hollonds said when people were struggling with their relationships "it often is
these additional stresses at a time of financial crisis that can tip you over the edge".
She expects divorces to continue rising for the next year or two as there's often a
lag between problems surfacing and couples actually deciding to split.
The ABS figures, released on Friday, note that the 2008 crude divorce rate of 2.2 per
1000 people was the lowest in 20 years.
The median age of males and females who were divorced in 2009 was 44.4 and 41.5 years
respectively.
The bureau also released the latest marriage statistics this week.
In 2009, there were 120,118 marriages registered in Australia, up 1.1 per cent on the
previous year's 118,756 weddings.
It was the highest level of marriage on record.
The median age of the men who were hitched last year was 31.5 years, while women were
slightly younger at 29.2.
"In both cases that was 0.1 years lower than in 2008," the ABS notes.
"The last time the median age at marriage fell was in 1973 for males and 1969 for females."
Relationship Australia's Ms Hollonds says if married couples are struggling as a result
of financial stress the key is to get help early.
People should seek financial advice and relationship counselling, she said.
"It's important that you don't just hope for the best."

The widow of a Brisbane road worker has made a heartfelt plea for safer workplaces.
25-year-old TOM TAKURAU died in hospital after being crushed by a concrete beam at
the Eastern Busway construction site at Buranda in inner-city Brisbane in December 2008.
His widow KRYSTAL ROSS has told a crowd of about 12 hundred union members and their
families at a rally to mark International Workers Memorial Day .. safety has to be a priority.
She says she doesn't want to see another name on another plaque .. on another construction
site .. for someone who was simply doing their job.
Ms ROSS and State Industrial Relations Minister CAMERON DICK have laid flowers at a
new stone memorial on Roma Street .. dedicated to workers who've died or been injured
at work.

BRISBANE, Aug 5 AAP - More than 300 teachers have rallied outside Queensland's parliament
to protest against the state government's refusal to further negotiate wage increases.
The Wednesday afternoon protest on George St in Brisbane was initially planned to be
a statewide teachers' strike before it was deemed illegal by the Queensland Industrial
Relations Commission.
The government has offered a 12.5 per cent pay rise over three years, but the teachers
want a higher increase, which includes up to 18 per cent over three years for some of
its members.
Queensland Teachers Union (QTU) president Steve Ryan said they had placed an application
before the commission asking for an interim one year pay increase of 5.4 per cent while
arbitration was being conducted.
Mr Ryan said he could not understand the government's four per cent interim offer,
saying teachers had already lost two months of their entitled pay increase due to the
negotiations.
He said the 5.4 per cent interim increase would equate to the government's original
4.5 per cent offer.
Mr Ryan also warned that while teachers could no longer strike, the QTU had plenty
of other tricks up their sleeve.
Queensland Independent Education Union general secretary Terry Burke said his members
would stand by the QTU as it sent the benchmark for teachers' pay across Queensland.
"Clearly we have to negotiate with our own employers, but our employers are always
very mindful of what happens in the public sector," he said.
Opposition education and training spokesman Bruce Flegg said the unfriendly brawl was
only harming teacher morale and retention.
"The length of time that has now passed with no increase allows the government a bit
of room to show some goodwill to teachers in relation to the interim increase that is
needed to be settled prior to arbitration," he said.
Education and Training Minister Geoff Wilson said he was pleased the teachers' rally
did not disrupt Queensland students or working families.
"I'll be meeting with a delegation from the union this afternoon," he said.
"Although the independent umpire is in charge of arbitration - my door is always open
to the Queensland Teachers' Union."
The commission has asked the parties to report back on August 20 on progress in identifying
the final matters to be arbitrated.

Traditional owners from four remote Northern Territory communities have agreed to give
up control of their land for 40 years under lease deals with the federal government.
In return .. almost 160 million dollars in federal and NT funds will be spent on new
and upgraded housing in Wadeye .. Maningrida .. Gunbalanya and Galiwinku over the next
five years.
That'll mean about 300 new houses and refurbishing of 250 existing homes.
The HOWARD government introduced a 99-year lease scheme in the hope it'd stimulate
economic development in townships .. but Nguiu in the Tiwi Islands was the only community
to sign one before Labor won office.

NSW: Pixar's star robot greets young fans with g'day

SYDNEY, Aug 24 AAP - He is a robot of few words but Pixar's latest star Wall-E greeted
young fans with waves and a few g'days at the Australian premiere of his film.
Local celebrities, such as Wayne Cooper, George Miller, Sophie Lee, Jono Coleman and
Jay Laga'aia, brought their children down the red carpet at the Entertainment Quarter
at Sydney's Moore Park to meet the one metre-high robot.
Wall-E stars in the Disney film of the same name about a waste compacting robot who
is left on earth after humans abandon it 700 years in the future.
The film, which opens on September 18, is the latest offering from the team behind
Finding Nemo, Monsters Inc and A Bug's Life.
It made $US63 million ($A68 million) in its opening weekend in America, and the buzz
is that it could become Pixar's first film to be nominated in the best picture category
at the Academy Awards.
Wall-E writer and director Andrew Stanton said he tried not to listen to those rumours.
"I want to put my fingers in my ears and start going la, la, la, la, la, because I'm
so superstitious," Stanton told AAP on the red carpet.
"But that's such a compliment from a really jaded community.
"It was made by a bunch of people who love movies and wanted to go back to what it
felt like to see these kind of movies that I saw in the 70s as a kid."
Stanton said it was amazing to be joined on the red carpet by the million dollar real-life
Wall-E.
"It still blows me away," he said.
"It's as if somebody made a robot of my child."
Wall-E whistled and bleeped, laughed, said his own name and charmed guests with a few
g'days for good measure.
Sound designer Ben Burtt, who has worked on ET and Star Wars, said Wall-E could convey
a lot despite his limited vocabulary.
"I kind of learned that you can piece together sound affects that have an emotional
feel to them without even being words that we recognise," Burtt said.
"It's kind of a universal language."

CANBERRA, April 18 AAP - The man who murdered a former Australian Federal Police commissioner
has failed in his latest attempt to have his conviction quashed.
David Harold Eastman was sentenced to life imprisonment for gunning down Assistant
Commissioner Colin Winchester in the driveway of his Canberra home in 1989.
Eastman, a former public servant, lost a 1997 appeal to the Full Court of the Federal
Court and a subsequent High Court bid in 2000.
A judicial review of his case was ordered in 2003, with Eastman arguing he was not
fit to plead at the time of his original 1995 trial.
Former ACT Chief Justice Jeffrey Miles ruled, after two years of hearings, that Eastman
had demonstrated sufficient tactical understanding of the trial process and had been able
to instruct his lawyers.
But Eastman sought to reopen his Federal Court appeal, saying Justice Miles stated
during the review that there had been an unresolved question of fitness to stand trial.
Eastman claimed that if the full bench of the Federal Court had inquired into the matter
there would almost certainly have been a retrial and the failure to inquire constituted
a denial of natural justice.
But today the Full Court of the Federal Court dismissed Eastman's application to have
the appeal reopened.
The full bench cited the 1938 Grierson High Court case which had determined that when
"the court has heard an appeal on its merits and given its decision the appeal cannot
be reopened."
In an unanimous decision Justices Jeffrey Spender, Peter Gray and John Logan found
that it appeared "most likely" that the Grierson principle admitted no exceptions.
And even if it did and an appeal could be reopened because of a denial of procedural
fairness, Eastman had "made out no case of any such denial".
"If Mr Eastman had had a claim of bias on the part of the full court, it would have
been open to him to make that claim on his appeal to the High Court," Justices Spender,
Gray and Logan said.
"The allegation of denial of procedural fairness is unsustainable."

WASHINGTON Manufacturers will have greater leeway to set minimum prices at the retail level without violating antitrust laws under a Supreme Court ruling Thursday that could hurt consumers and small merchants.
By allowing minimum-price agreements, the court's 5-4 decision could lead to higher prices, dissenting justices said, as it becomes more difficult for smaller stores and Internet retailers to offer lower-priced goods.
The court said agreements on minimum prices are legal if they promote competition, meaning accusations of antitrust violations will be evaluated case by case.
In a 1911 decision, the Supreme Court had declared that minimum-pricing agreements always violate federal antitrust law. But Justice Anthony Kennedy wrote in the majority opinion that the principle that past decisions should be left alone "does not compel our continued adherence" in this instance.
Minimum-price agreements can benefit consumers, Kennedy wrote, by enabling retailers to invest in greater customer service without fear of being undercut by discount rivals. The agreements also could make it easier for new products to compete, he added, because a retailer could recoup the costs of marketing a new good by charging a higher price.
Dissenting from that view, Justice Stephen Breyer wrote:
"The only safe predictions to make about today's decision are that it will likely raise the price of goods at retail."
The Consumer Federation of America said in court filings that the ban on minimum-price agreements allowed "innovative retailers to continually enter the market, offering new and lower-priced alternatives to consumers."
But Roy Englert, an antitrust attorney, said the court's decision does have boundaries that will protect entrepreneurs. The ruling only allows minimum-price agreements between manufacturers of a single brand of a product and retailers, Englert said, while other brands of the same product can still compete on price.
Moreover, if only one brand is available, retailers and consumers can still sue manufacturers for anti-competitive conduct, Englert said. The courts will now evaluate such suits on the merits, rather than automatically finding them illegal.
Englert helped prepare a brief in support of the defendant in the high court case.
Some antitrust experts say consumers shopping on the Internet will be hurt by abandoning the 96-year-old rule.
Richard Brunell, director of legal advocacy for the American Antitrust Institute, said price floors pose little risk to large chains such as Wal-Mart Stores Inc. because "it is no longer the new kid on the block" and has sufficient clout to get whatever products it wants without any price restrictions.
Today, incumbent retailers like Wal-Mart actually might find price floors to be an effective tool against Internet discounting, Brunell said.
In recent decades, the Supreme Court has chipped away at what many economists traditionally regarded as vital consumer protections against anticompetitive conduct. For example, exclusive dealer territories and setting price ceilings are no longer automatically unlawful.
The current case involves Leegin Creative Leather Products Inc., based in City of Industry, Calif. The company entered agreements with retailers setting minimum prices for the Brighton brand of women's fashion accessories.
Leegin said that by maintaining price consistency among niche retailers it sells to, businesses can offer improved customer service. This enables smaller stores to compete against rival brands sold by discounters, Leegin argues.
Several retailers in Dallas selling Leegin's products lowered prices below the minimum. Family operated Kay's Kloset said it followed suit to stay competitive. Phil and Kay Smith say that when they refused to raise prices back up, Leegin cut off their supply. Kay's Kloset sued and the Smiths won a $3.6 million judgment following a trial that laid out details of the price-floor arrangement between Leegin and many of its retailers. The 5th U.S. Circuit Court of Appeals upheld the lower court's finding.

Qld: Missing snorklers found safe and well
BRISBANE, Feb 1 AAP - Two snorkellers have been rescued after spending several hours
clinging to a rockface in waters off Queensland's Sunshine Coast.
The men, aged 40 and 25, had been snorkelling off Double Island Point, north of Noosa,
yesterday afternoon, but authorities were called when they failed to return to shore.
They were last seen snorkelling near rocks at 3pm (AEST).
Police, Coastguard and the Queensland Emergency Services helicopter began searching for the men.
The helicopter found the men clinging to a rockface shortly after 11pm (AEST) yesterday
though both were unhurt.

Justice Whealy said Lodhi has been kept in segregated custody since his April 2004
arrest, except for a brief period.
He recommended prison authorities "not lose sight" of the need to reclassify Lodhi
at an early stage of his prison term.
"No matter how much we may deplore and disapprove of a particular offender, no matter
how repulsive we may find his or her actions we sacrifice our essential decency if we
fail to treat him or her as a fellow human being," Justice Whealy said.

SAN FRANCISCO: Google faced a lawsuit after it unveiled a free mobile application that turns a smartphone into an electronic wallet and is designed to replace plastic credit cards.
PayPal and eBay filed a lawsuit in a California state court on Thursday charging that the Internet giant tapped into trade secrets for its newly released Google Wallet. Google did not immediately respond to the allegations.
PayPal spent three years trying to work out a deal in which it would handle payments for Android smartphones, only to see Google scuttle the talks and hire its lead negotiator Osama Bedier, according to court documents.
Bedier worked at the eBay-owned online financial services unit as a vice-president of platform, mobile, and new ventures until being hired in January by Google.
He played a central role at Google's official unveiling in New York with financial partners Citibank, MasterCard and First Data and telecom ally Sprint, saying Google Wallet is being field tested and will be available this summer.
Google Wallet will initially work with Google's Nexus S 4G smartphone from Sprint, the third-largest US wireless provider, and will eventually be expanded to other phones equipped with near field communication (NFC) technology.
An NFC chip in a phone allows a user who has entered his or her credit card details to "tap-and-pay" for purchases at a checkout register equipped with the PayPass system from CitiMasterCard.
Customers can also use a Google Prepaid card to pay for purchases and take advantage of Google Offers, the Mountain View, California-based company's online discount coupon program.
The company said Google Wallet will be accepted at more than 124,000 US merchants at launch and more than 311,000 around the world.
Stephanie Tilenius, Google's vice-president for commerce and payments, described Google Wallet as the "next generation of mobile commerce."
"We're building an open commerce ecosystem that for the first time will make it possible for you to pay with an NFC wallet and redeem consumer promotions all in one tap, while shopping offline," Tilenius said. "We are looking at expanding internationally, Europe first and then Asia."
The PayPal lawsuit contends that Tilenius helped Google poach Bedier and named both executives and the Internet company as defendants in a civil case alleging misappropriation of trade secrets.
Mobile payments are being tested or used in a number of countries already, notably France and Japan, but Google Wallet will be among the first to bring NFC technology to stores in the United States.
NFC technology uses short-range, high frequency wireless to enable the encrypted exchange of information between devices at a short distance.
Three of the largest US wireless carriers - AT&T, T-Mobile and Verizon Wireless - announced in November that they were teaming up to build a national network called "Isis" to allow for payments by mobile phones.
They said they expect to introduce the service during the next 18 months.
Then-Google chief executive Eric Schmidt said shortly before the Nexus S smartphone hit the market in December that he expects tap-and-pay technology to eventually replace credit cards.
Forrester Research analyst Charles Golvin said it remains to be seen, however, whether Google can change the payment behaviour of consumers, and it will take time and more widespread adoption to find out.
"Relying on an installed base of phones that is today indistinguishable from zero, a single payment system, a single card issuer, and a modest network of merchants capable of accepting these phone-based payments means that the near-term impact will be negligible," Golvin said. Andrew Eisner, director of community and content at Retrevo, agreed that "the big question is how consumers will warm up to NFC," he further added.

ACE*COMM Awarded Iowa Communications Network Electronic Billing System Contract

Childhood Cancer Survivors: A Practical Guide to Your Future is one of a series of patient-centered guides written to provide parents with information and practical advice to care for children with cancer. The book provides a comprehensive and thorough account of issues that pediatric cancer survivors and their families will face. Although other print and Internet resources are available for survivors and families, this book is a valuable resource because of its dual focus on pediatric cancer survivors and the issues pertinent to them.

The book is divided into 20 chapters; each chapter is well written and easy for the lay person to read. The early chapters concentrate on psychosocial issues, relationships, navigating the system, staying healthy, fatigue, and emotions. In addition, the authors are not afraid to cover sensitive topics, such as sexuality and fertility. The latter section of the book focuses on body systems and discusses the potential effects that certain treatments, if received, might have on the organs in each system. The authors are careful to emphasize that not all patients will experience every problem covered in the book, if any; however, if families fail to note or understand this, they may find the chapters a bit overwhelming.
Most of the chapters include comments of survivors and parents regarding their experiences, which gives the book a more personal feel but also can be distracting. The powerful impact of hearing the voices of people who have gone through pediatric cancer, however, far outweighs this minor detail. The comments are pertinent, and positive and negative accounts of survivors and their families are portrayed in an honest narrative.
The appendices in the book provide valuable information about resources available to pediatric cancer survivors and their families. Resources mentioned include a Web site to find a survivors' clinic, organizations for pediatric cancer survivors that provide services and information, books, and other Internet sites. Because the book is in its second edition, resources have been updated. The Cancer Survivor's Treatment Record pullout insert at the end of the book is a very useful resource. So many pediatric cancer survivors are unaware of the treatments they receive, let alone specific medications and dosage amounts. With more children surviving cancer every day, long-term follow-up of their health issues has become imperative. The insert provides survivors and healthcare providers with the tools to anticipate and deal with any health problems encountered years after treatment is completed.
Childhood Cancer Survivors: A Practical Guide to Your Future allows pediatric cancer survivors to take ownership of their disease and gives them the tools to deal with the long-term sequelae (physical and emotional) they might face later in life. The book can serve as a conduit for healthcare providers, survivors, and their families to talk about the issues unique to this patient population.

Throw the switch on a revamped yard.

Apr. 17--Yard looking dreary? Haphazard? Like no one has touched it all year?
If you dream of a lush, colorful backyard, a place where family and friends can gather for barbeques or garden parties, consider entering our Backyard Switch contest.
Last year, winners Ted and Lyn Carrington traded yards with Scott and Melanie Hunsaker. While the Hunsakers simply needed a well laid-out space to share with guests and their four children, the Carringtons' yard was a bigger challenge.
"It is a complete disaster offering nothing but weeds and dirt, and who wants to look at that? I know I don't," Lyn Carrington said last year, before the switch.
After the switch, the Carringtons invited friends and family to enjoy their improved landscaping. The result? "They were amazed," Ted Carrington said last week. "It just looks real nice the way they've laid it out."
The improvements, accomplished with supplies and design advice from Kimberly Nurseries and labor from the Hunsakers, had languished on Ted Carrington's to-do list.
"I don't know how long it would have taken me to get around to it, maybe another couple summers," he said. But Backyard Switch came to the rescue. "It put me maybe a couple years ahead."

It's time again for the annual Backyard Switch. This year you could win, but only if you enter!
Entrants must live in the Times-News' eight-county circulation area -- Blaine, Camas, Cassia, Gooding, Jerome, Lincoln, Minidoka and Twin Falls counties -- and must either own their property or have written permission from the owner to landscape it.
Two winning households will trade yards long enough to create a landscaping masterpiece -- with help from the pros.
In both cases, the work must be done by a minimum of two people at least 16 years of age, although friends and family members are welcome to chip in. The two families chosen must be able to take the same two-day period between May 15 and June 12 to accomplish the landscaping. A third day may be used if additional work time is needed, if both families agree on a date, but the project must be completed with no more than three days of work.
Participants will have help with design from the professionals at Kimberly Nurseries in Twin Falls, which will also supply up to $1,000 in plants and other materials for each yard. But the homeowners will be responsible for all labor.
Pick up an application at the Times-News' downtown office or at Kimberly Nurseries. An application is also included in today's newspaper, and on the Internet at www.magicvalley.com (click "Backyard Switch"). Applications must be received by May 8.
Include photos of all angles of the area to be transformed, a photo of the exterior of the house and a photo of the would-be participants. Mail these photos and the completed application to: "Attn: Backyard Switch," Times-News, P.O. Box 548, Twin Falls, ID 83303.
Winners will be announced in the Times-News' Country Roads section on May 15. The work must be completed by June 12, and a story about the completed yards will be published in Country Roads on June 26.

Revenues for the nine months ended January 31, 2006 increased 742% to $33.0 million as compared to $3.9 million for the same period in the prior fiscal year, while net earnings rose to $1.3 million or $0.13 per share (basic) compared to a loss of $690 thousand or $0.14 per share for the same period in the prior fiscal year. Avaya Enterprise Connect Solutions Help Protection One Link 50 Branch Offices, Enhance Service and Reduce Costs with Converged Network and Applications.

When completed, the new network will extend Avaya MultiVantage(TM) Communications Applications -- including Internet Protocol (IP) telephony, messaging and contact center applications -- to more than 50 Protection One branch offices, enabling the company to enhance customer service and sales responsiveness, reduce costs, and improve efficiency and productivity.
A strong local presence is key to Protection One's success in serving more than one million residential and commercial customers across the United States. The company's "Get Local" campaign has increased each branch's responsibility for customer service, customer retention and new sales. However, the assortment of standalone voice and data systems used across Protection One's branch offices limited the company's ability to reduce costs and to serve its customers efficiently. Increased collaboration between branches will also help the company respond more quickly to customer calls and sales opportunities. If a local branch is either closed because of weather conditions or is experiencing high call volume and local staff is busy assisting other customers, customer center management can easily engage another branch office to help handle calls. Protection One will also be able to migrate existing telephony and customer center functions easily into the new, IP-based network, an important factor for reducing implementation and training time.

Local Protection One branches will host Avaya S8300 Media Servers, Avaya G700 Gateways and Avaya P330 MultiService Switches to maximize the ability of each branch to continue operations if the wide area network is affected.
